We are delighted that the UK Court of Appeal has today granted Dr Thaler the right to appeal the DABUS decision, which involves the important issue of patentability of inventions created by AI systems. Williams Powell is handling the DABUS patent applications as well as the UK and EPO appeals.
The cases had been rejected by the UK High Court.
The order allowing the appeal by the Rt. Hon. Lord Justice Floyd states:
"The decisions both here and in corresponding proceedings in the EPO and the USA have attracted a degree of international interest. Although the grounds of appeal might struggle to meet the criterion in CPR 52.6(1)(a), I grant permission under CPR 52.6(1)(b). The principle at stake is an important one."
